Terms & Conditions

FUNCTION MANSFIELD — MEMBERSHIP TERMS & CONDITIONS

1. Membership
Membership is personal to the named member and cannot be transferred or shared. Members must provide accurate and up-to-date information when joining.

Membership benefits and access depend on the membership package purchased. Certain services, classes, recovery facilities or activities may require advance booking and may be subject to separate rules.

2. Membership Categories
Function Mansfield may offer memberships including Gym Only, Classes Only, Gym + Classes and All-In memberships.

Access is limited to the facilities and services included within the membership purchased. Function may introduce, remove or amend membership categories from time to time. Existing members will be notified where a change materially affects their membership.

3. Membership Payments
Membership fees are payable in advance by the payment method agreed when joining.

Where membership is paid monthly, payment will be collected automatically on the agreed payment date.

Members are responsible for ensuring sufficient funds and valid payment details are available.

If payment fails, access to the facility, classes and/or booking system may be temporarily suspended until the outstanding balance is paid.

We reserve the right to recover reasonable costs actually incurred as a result of unpaid membership fees, where permitted by law.

4. Joining & Minimum Age
Members must meet the minimum age requirement applicable to their membership or activity.

Anyone under 18 may be required to obtain consent from a parent or legal guardian. Certain areas, equipment, classes and recovery facilities may have additional age restrictions.

5. Health & PAR-Q
Members must complete a health questionnaire/PAR-Q where requested before participating in exercise.

Members are responsible for informing Function of any relevant changes to their health that may affect their ability to exercise safely.

Members should seek appropriate medical advice before exercising where they have concerns regarding their health or ability to participate.

Completion of a PAR-Q does not replace professional medical advice.

6. Gym Use
Members must use equipment responsibly and in accordance with instructions provided by Function staff and equipment manufacturers.

Weights and equipment must be returned after use.

Members must not deliberately misuse or damage equipment or facilities.

Appropriate clothing and footwear must be worn.

Function reserves the right to restrict access to equipment or areas where reasonably necessary for maintenance, classes, events, health and safety or operational requirements.

7. Classes
Classes are subject to availability and must be booked through the approved booking system where required.

Class timetables, instructors and formats may change.

Function does not guarantee availability in any particular class.

Members should arrive in sufficient time for their class. Late arrivals may be refused entry where participation would be unsafe or disruptive.

8. Class Cancellations & No-Shows
Booked classes should be cancelled within the cancellation period shown within the booking system.

Late cancellations and non-attendance may result in the loss of a class credit where applicable.

For memberships with unlimited classes, repeated late cancellations or no-shows may result in temporary booking restrictions and/or a reasonable charge where this policy has been clearly communicated in advance.

This is particularly important to us because unused bookings prevent other members from attending.

9. Sauna & Ice Bath / Recovery Facilities
Recovery facilities are only available to memberships or passes that specifically include them.

Members must follow all displayed safety instructions and staff guidance.

Members use sauna and cold-water facilities at their own discretion and should not use them where they have a medical condition, are pregnant, feel unwell, are under the influence of alcohol or drugs, or have otherwise been advised not to use heat/cold exposure.

Members with any uncertainty regarding suitability should obtain appropriate medical advice before use.

Function may impose time limits, booking requirements or capacity restrictions.

10. Personal Belongings
Members are responsible for their own belongings while using the facility.

Function does not accept responsibility for loss, theft or damage except where this results from Function's negligence or where liability cannot legally be excluded.

11. Conduct
Function is built around community and members are expected to treat other members, staff, coaches and visitors with respect.

Aggressive, threatening, discriminatory, abusive, intimidating or inappropriate behaviour will not be tolerated.

Members must not behave in a manner that creates an unreasonable risk to themselves or another person.

Serious or repeated breaches may result in suspension or termination of membership.

12. Photography & Social Media
Photography and filming may take place within Function for marketing and social-media purposes.

Where individuals are the identifiable focus of promotional content, Function will obtain appropriate permission where required.

Members taking their own photographs or videos must respect the privacy of other members and must not deliberately film another member without their permission.

13. Personal Training
Only Function-approved personal trainers/coaches may provide paid personal training or coaching services within the facility.

Members must not conduct commercial coaching or personal training without prior written permission from Function.

14. Opening Hours & Facility Availability
Opening hours may change from time to time.

Parts of the facility may occasionally be unavailable because of maintenance, repairs, cleaning, events, classes or circumstances outside our reasonable control.

Reasonable temporary changes to opening hours or facility availability do not automatically entitle a member to a refund. This does not affect the member's statutory rights where there is a significant or prolonged reduction in the service provided.

15. Membership Cancellation
Cancellation rights depend on the membership purchased and any minimum membership period clearly disclosed before purchase.

For rolling monthly memberships, members may cancel by giving the notice specified when joining.

Where a membership has a minimum contractual period, the member remains responsible for payments during that minimum period unless cancellation is permitted under the membership agreement or applicable law.

Nothing within these terms affects any statutory cancellation rights, including any applicable rights for contracts entered into online or at a distance.

16. Membership Freezes
Membership freezes may be permitted in circumstances and on terms determined by the membership package.

Any applicable freeze period, charge and eligibility requirements will be communicated when a freeze is requested.

Function may make reasonable exceptions for circumstances such as significant injury, illness, pregnancy or other exceptional situations.

17. Price Changes
Function may change membership prices.

Members will receive reasonable advance notice of any increase affecting their existing recurring membership and will be informed of any applicable right to cancel before the new price takes effect.

Where a specific membership is advertised as having a guaranteed or fixed Founding Member rate, the specific terms of that offer will apply.

18. Suspension or Termination
Function may suspend or terminate membership for serious or repeated breaches of these terms, including abusive behaviour, deliberate equipment misuse, fraud, sharing membership access or persistent non-payment.

Where appropriate, Function will provide reasonable notice and an opportunity to resolve the issue before termination, except where immediate action is reasonably required for safety, security or serious misconduct.

19. Liability
Exercise and physical activity carry inherent risks.

Function will take reasonable steps to provide a safe training environment and appropriately maintain its facilities and equipment.

Nothing in these terms excludes or limits Function's liability where it would be unlawful to do so, including liability for death or personal injury caused by Function's negligence.

Members remain responsible for exercising within their own abilities and following reasonable safety instructions.

20. Data Protection & CCTV
Personal information will be processed in accordance with Function's Privacy Policy and applicable UK data-protection legislation.

CCTV may operate within the premises for security, safety and crime-prevention purposes. Appropriate signage will be displayed.

21. Changes to These Terms
Function may make reasonable changes to these terms where necessary because of changes in law, safety requirements, operating procedures or the services provided.

Where a change materially disadvantages an existing member, reasonable notice will be provided and any applicable cancellation rights will be explained.

22. Consumer Rights
Nothing within these Terms & Conditions affects your statutory rights as a consumer.
